Terms of Service

These Terms of Service ("Terms") govern your use of Shop Simply, a service operated by Tech Mage (Pty) Ltd("we", "us", "our"). By registering an account or using the platform you agree to be bound by these Terms.
1. The service
Shop Simply provides a hosted e-commerce platform for South African small business owners. We provide the software, hosting, and subdomain. You provide the products, pricing, and customer relationships.
2. Account registration
You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and legally able to enter into contracts under South African law.
3. Subscription and payment
Access to the platform requires an active monthly subscription, billed via Paystack. Subscription fees are charged in South African Rand (ZAR). See our Pricing page for current rates and our Refund Policy for cancellation terms.
4. Your content and products
You retain ownership of all content you upload (product images, descriptions, etc.). You grant Shop Simply a limited licence to store and serve that content as part of operating your shop. You are solely responsible for ensuring your products and content comply with South African law.
5. Payments and Payfast
Shop Simply does not process payments between you and your customers. Customer payments flow directly through your own Payfast merchant account. Shop Simply never holds, touches, or has access to customer payment funds.
6. Prohibited use
You may not use Shop Simply to sell:
- Illegal goods or services under South African law
- Counterfeit or infringing products
- Adult content
- Weapons, drugs, or controlled substances
We reserve the right to suspend or terminate accounts that violate these restrictions without notice.
7. Data and privacy
We handle personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).
8. Availability and liability
We strive for high availability but do not guarantee uninterrupted service. Shop Simply is provided "as is". To the maximum extent permitted by law, we exclude liability for any indirect, incidental, or consequential loss arising from your use of the platform.
9. Termination
You may cancel your subscription at any time. We may suspend or terminate your account if you breach these Terms or if required by law.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.
11. Changes to these Terms
We may update these Terms from time to time. We will notify active subscribers by email before material changes take effect.
